These Terms and Conditions govern the use of the website operated by Sailing Flavors S.R.L. and apply to all visitors and users of the website. Any yacht charter service is subject to a separate and subsequently signed Charter Agreement.

2. NATURE OF SERVICES

Sailing Flavors S.R.L. provides information, booking management, and facilitation services related to yacht charter experiences, offered either as bareboat charters or with a professional skipper.

Any request or reservation initiated through this website represents an intention to book only and does not constitute a binding contract.
All yacht charters are subject to the availability of the vessel and the mandatory signing of a separate Charter Agreement (Rental Agreement).

In the event of any conflict or inconsistency between these Terms and Conditions and the provisions of the Charter Agreement, the Charter Agreement shall prevail.

3. INTELLECTUAL PROPERTY

All content displayed on this website, including but not limited to text, images, videos, logos, itineraries, and graphic materials, is the exclusive property of Sailing Flavors S.R.L. and is protected by applicable copyright and intellectual property laws.

Any reproduction, distribution, modification, republication, or commercial use of the website content without prior written consent from Sailing Flavors S.R.L. is strictly prohibited.

 

4. USER REPRESENTATIONS

By accessing or using this website, you represent and warrant that:

1. You have the legal capacity to enter into agreements under applicable law;

2. You are not a minor in the jurisdiction in which you reside;

3. You will not use automated systems, bots, scripts, or similar means to access the website;

4. Your use of the website complies with all applicable laws and regulations.

 

5. BOOKINGS, PAYMENTS, AND CANCELLATIONS

Booking Process
A booking request submitted via the website constitutes a non-binding request. A reservation becomes effective only after availability confirmation and receipt of the required deposit.

Payments
All prices are displayed in EUR. Payments are made via bank transfer or other payment methods communicated during the booking process.

Cancellation Policy
Unless otherwise stated in the Charter Agreement:

• 0% fee for cancellations made within 24 hours of the initial booking request;

• 20% cancellation fee for cancellations made more than 60 days prior to the charter start date;

• 100% cancellation fee for cancellations made within 60 days of the charter start date.

Cancellation terms may vary depending on the specific Charter Agreement, vessel owner, or supplier conditions.
All cancellations must be submitted in writing to: office@sailingflavors.com.

 

6. RIGHT OF WITHDRAWAL

In accordance with Directive 2011/83/EU on consumer rights, the statutory right of withdrawal does not apply to leisure services provided on a specific date or within a specific period, such as yacht charter services with fixed departure dates.

 

7. LIMITATION OF LIABILITY

The website content is provided for general informational purposes. While reasonable efforts are made to ensure accuracy, Sailing Flavors S.R.L. shall not be held liable for technical errors, service interruptions, or indirect damages arising from the use of this website.
Liability related to the charter service itself is strictly limited to the obligations expressly set out in the applicable Charter Agreement.

Sailing Flavors S.R.L. does not provide personal travel or health insurance. Guests are strongly advised to obtain comprehensive insurance coverage prior to the charter.

 

8. FORCE MAJEURE

Sailing Flavors S.R.L. shall not be liable for failure or delay in the performance of its obligations due to events beyond its reasonable control, including but not limited to weather conditions, natural disasters, governmental actions, port authority restrictions, strikes, or other force majeure events.

 

9. PHOTOGRAPHY AND MARKETING

During charter activities, photographs or video recordings may be taken for promotional purposes based on legitimate business interest.

If a participant does not wish to appear in promotional materials, they must notify Sailing Flavors S.R.L. in writing prior to the charter start date. This request will be respected where reasonably possible.

 

10. PERSONAL DATA PROTECTION

Personal data is processed in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR).

11. GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed by and construed in accordance with the laws of Romania.
The courts of Romania shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

 

12. MODIFICATIONS

Sailing Flavors S.R.L. reserves the right to modify or update these Terms and Conditions at any time. Changes become effective upon publication on the website, with the “Last Updated” date revised accordingly.
